This round is referenced in FM 23-75 "37-mm GUN, M1916" from 1940, without picture or drawing.
 
This round like I think many of these were likely made up in
Army Depots or workshops. The colour for an Army Drill round
projectile is black. This projectile is HE yellow, which to me indicates
using what was on hand. The M5 marking was applied later when
the Mk designation system was introduced and it was stamped
and still not updated, (though certainly accepted) with a new coat of black paint. Sort of
like the 1916 MK1 black powder loaded projectiles that are black
instead of red. An unusual anomaly, to find one of these HE projectiles
with the original yellow is a rare treat from my experience.
