I agree,one way to tell is to measure the diameter below the drive band as the Oerlikon will be around 18.5-19mm,the projectile colour does seem to be the same as a French Hispano round I have seen.

The band forcing of Hispanio tend to be wider than those of oerlikon
The picture seems more of a oerlikon that of a Hispanio.
Do you have any type of mark on the bullet cold?

Might not it be 20 millimeters breda? I have in my collection the similar one but with marked case H 37
